Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Foddy LLC ("we", "us", or "our"), the operator of FiveColorFolio. By creating an account or using the service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use FiveColorFolio.

You must be at least 13 years old (or the minimum age required by your local law, if higher) to create an account.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at info@foddy.store if you suspect unauthorized access.

You agree to provide accurate information when registering and to keep it up to date.

You may not create accounts for others without their permission, share your account with other people, or use the service on behalf of a third party without appropriate authorization.

FiveColorFolio offers Free and Plus subscription plans. Plus costs $4.99 per month and is billed through Stripe.

If you are eligible for the introductory offer, Plus begins with a 14-day free trial and requires a payment method at signup. Unless you cancel before the trial ends, Stripe will charge that payment method $4.99 when the trial ends and monthly thereafter. Accounts that have previously started a paid subscription are not eligible for another trial and are charged $4.99 at checkout.

By subscribing to Plus, you authorize us to charge the payment method you provide on a recurring basis as disclosed at checkout.

Subscriptions renew automatically at the end of each monthly billing period until you cancel.

Prices are displayed in USD and are subject to change. We will notify you of any price changes before they take effect. Continued use of the service after a price change constitutes your acceptance of the new price.

All charges are processed by Stripe. We do not store your full payment-card number. Stripe's terms of service apply to the payment relationship.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until then.

If you cancel during an eligible free trial before it ends, you will not be charged the first monthly subscription fee.

We do not offer prorated refunds for unused time on a cancelled subscription except where required by applicable law or at our sole discretion.

If you believe you were billed in error, contact us at info@foddy.store within 30 days of the charge. We will investigate and, if an error is confirmed, issue a refund.

You agree not to use FiveColorFolio to:

Violate any applicable law or regulation.

Attempt to gain unauthorized access to any part of the service or its infrastructure.

Scrape, crawl, or otherwise extract data from the service at a scale that disrupts normal operation.

Upload or transmit malware, spam, or any content that infringes the rights of others.

Reverse engineer or decompile any part of the service.

We reserve the right to suspend or terminate accounts that violate these rules.

FiveColorFolio and its original content, features, and functionality are owned by Foddy LLC and are protected by applicable intellectual property laws.

Magic: The Gathering card names, set names, card text, and card imagery are the intellectual property of Wizards of the Coast LLC. FiveColorFolio is not affiliated with, endorsed by, or sponsored by Wizards of the Coast.

Card metadata and market-price fields are sourced through catalog data providers including Scryfall and MTGJSON. Price fields may be attributed to marketplaces such as TCGplayer and Card Kingdom. That data belongs to its respective owners and is used subject to applicable provider terms.

Your collection data (the records you create in the app) belongs to you. You may export it at any time. By storing data with us, you grant us a limited license to process and display it solely to provide the service to you.

FiveColorFolio is a collection-tracking tool. It provides portfolio estimates based on third-party market price data. THESE ESTIMATES ARE NOT INVESTMENT OR FINANCIAL ADVICE. We make no guarantee that the prices shown reflect actual market values, transaction prices, or liquidity.

Market price data comes from third-party catalog sources and may be delayed, inaccurate, or unavailable. You should not rely on FiveColorFolio pricing data alone to make buying, selling, or trading decisions.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FODDY LLC AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain types of damages. If those laws apply to you, some of the above limitations may not apply.

To close your account, email info@foddy.store from the address associated with your account. We may verify your identity before processing your request.

We reserve the right to suspend or terminate your account without prior notice if you violate these Terms, engage in conduct that harms the service or other users, or if required to do so by law.

Upon termination, your right to use the service ceases immediately. We will delete your personal data in accordance with our Privacy Policy.

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law provisions.

Any dispute arising out of or relating to these Terms or your use of the service shall be resolved exclusively in the courts of the State of New York, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify you by email at least 14 days before the changes take effect.

Your continued use of FiveColorFolio after the effective date of revised Terms constitutes your acceptance of the changes.
